My neighbor was coming back from a successful elk hunt in Colorado. They stopped for fuel/food in Arkansas; some AR and Fed game wardens were eating in the same cafe and came out to see his rack - then arrested him and confiscated the animal because he had not boiled the skull before transporting through a non-CWD state. It was his best bull ever, there's an article with photo at

He was ignorant of the requirement for CWD testing, and offered to pay the fine and pay for the testing if they would return the critter - no deal. They claim the meat is in a freezer, and that the judge may award it to him when he goes back for the trial.
So, beware and know the rules when transporting from states that have a reported CWD case through those that do not.

Check your own state laws also. Many states have these regulations in place now to prevent CWD from spreading.

How would a dead elk head be able to transport CWD to a wild deer? Does it spread thru airborne methods, or would a live animal have to eat part of the brain? Just curious.

It's up to the judge. Like he said in the article, he's not disputing his guilt, just doesn't want to see the animal wasted.

I'm crying for him. Seriously, this breaks my heart for the fella. I'm imagining all the time, effort and money that went into the hunt, not to mention the excitement of success only to lose everything. A crying shame is what it is. I had no idea of the regulation either.
